Why you should register your trademark.

  1. Registering your Mark puts others on Notice that you are the owner of the Mark and acts to deter others from using your valuable Mark.
     
  2. Registering your Mark helps to protect your good will and reputation by preventing others from degrading or diluting your brand.
    • Keep infringers from taking advantage of your hard work and investment and confusing the public and in particular, your customers or potential customers, that your brand or Mark belongs to them.
  3. Registration acts to protect your investment in developing your brand or mark, including, but not limited to the logo art, brainstorming, research and advertising and marketing campaign costs.
     
  4. Build value into your company by developing and maintaining brands that become known to the public and have a good reputation.
    • Licensing of your brand may assist you to further advertise/market your brand and create a way to generate royalty income for your company.
  5. Protect your mark and keep others from using it.
    • Registration of your Mark means that you are considered the rightful owner and serves as prima facie evidence thereof.
       
    • However, in cases where the infringer refuses to cooperate, you may sue the infringer and the infringer will have the burden of proving that you do not have an exclusive right to the Mark and in certain situations, attorney fees may be available.
